These Terms of Service ("Terms") govern your access to and use of PlanYourWay ("we," "us," or "our"), including our website and any planning tools, checklists, resources, and subscription services offered through it (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

PlanYourWay provides educational planning tools and informational resources to help individuals organize their healthcare, financial, digital, and end-of-life planning across all 50 U.S. states. The Services include state-specific planning step guidance, progress tracking, downloadable checklists, email reminders, and curated links to third-party public resources. The Services are provided for general educational and organizational purposes only. Nothing in the Services constitutes legal, medical, financial, or professional advice. Always consult a licensed attorney, financial advisor, or healthcare professional before making decisions based on information found here.

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

Some features of the Services require account registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@life-bridge-plan.com if you suspect unauthorized use of your account. We are not responsible for any losses resulting from unauthorized access due to your failure to safeguard your credentials.

Access to premium features of the Services requires a paid subscription. Subscriptions are available on a monthly ($1.99/month) or annual ($20.00/year) basis and are processed through Base44 Payments. Fees are charged in advance and are non-refundable except as required by applicable law. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We reserve the right to modify pricing at any time with reasonable notice. If your payment fails, we may suspend or terminate your access to premium features until payment is resolved.

You may cancel your subscription at any time by contacting us at support@life-bridge-plan.com. Cancellation takes effect at the end of the current billing period. You will retain access to premium features through the end of the period you have paid for. We do not provide partial refunds for unused subscription time.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not: • Use the Services in any way that violates applicable federal, state, or local laws or regulations • Attempt to gain unauthorized access to any portion of the Services or its related systems • Reproduce, distribute, modify, or create derivative works of the Services without our express written consent • Use automated tools, bots, scrapers, or similar means to access or collect data from the Services • Impersonate any person or entity or misrepresent your affiliation with any person or entity • Upload or transmit any harmful, offensive, or unlawful content

All content, design, code, text, graphics, and materials on the Services are owned by or licensed to PlanYourWay and are protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes only. You retain ownership of any personal planning data or information you input into the Services. We do not claim ownership over your personal data.

We are committed to protecting your privacy. Any personal information you provide — such as your name, email address, or state selection — is used solely to provide and improve the Services, including sending monthly planning reminders if you opt in. We do not sell or share your personal information with third parties for marketing purposes. Address, insurance, or location information entered into search tools is processed entirely within your browser and is never transmitted to or stored by our servers. The Services may contain links to third-party websites, including government agencies, nonprofit organizations, legal directories, and health insurers. These links are provided for convenience and informational purposes only. We do not endorse, control, or take responsibility for the content, accuracy, or practices of any third-party sites. Your use of third-party sites is governed by their own terms and privacy policies.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. THE INFORMATION PROVIDED THROUGH THE SERVICES IS FOR GENERAL EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, MEDICAL, OR FINANCIAL ADVICE. LAWS AND REGULATIONS VARY BY STATE AND CHANGE FREQUENTLY. ALWAYS SEEK THE ADVICE OF QUALIFIED PROFESSIONALS BEFORE ACTING ON ANY INFORMATION OBTAINED FROM THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLANYOURWAY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless PlanYourWay and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party rights.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must discontinue use of the Services.

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, at our sole discretion. Upon termination, your right to use the Services will immediately cease. Sections 7, 10, 11, 12, and 15 of these Terms will survive termination.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which PlanYourWay operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as mutually agreed.
